Welcome to TeeDistrict! These Terms of Service (“Terms”) govern your use of the TeeDistrict website (the “Site”) and the services we offer. By accessing or using our Site, you agree to be bound by these Terms.

1. Eligibility and Site Use

To use our Site and services, you must be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction. By using our Site, you represent and warrant that you meet these requirements. You agree to use the Site for lawful purposes only and in accordance with these Terms.

2. User Accounts

To place an order, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User-Generated Content (Designs, Logos, Artwork)

• Your Rights: You retain all ownership rights to the logos, designs, text, and artwork you upload to the Site (“User Content”).
• License to TeeDistrict: By uploading User Content, you grant TeeDistrict a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and manufacture products from your User Content for the sole purpose of fulfilling your order.
• Content Responsibility: You are solely responsible for your User Content. You represent and warrant that:
  • You own the User Content or have all necessary rights, licenses, and permissions to use it.
  • Your User Content does not and will not infringe upon the intellectual property rights (including copyright, trademark, and patent rights), privacy rights, or any other legal rights of any third party.
• Prohibited Content: You may not upload any User Content that is unlawful, hateful, abusive, obscene, discriminatory, in violation of any person’s or entity’s copyright or trademark, defamatory, or invasive of privacy.
• Right to Refuse: TeeDistrict reserves the right, in its sole discretion, to refuse to print any User Content that it believes violates these Terms or is otherwise objectionable.

4. Copyright and Intellectual Property Policy

TeeDistrict respects the intellectual property of others. By using our service, you agree to indemnify and hold TeeDistrict harmless from any claims, damages, and costs (including legal fees) arising from the printing of your User Content, especially in cases of intellectual property infringement.

5. Ordering and Payment

• Order Placement: All orders must be placed through our Site. You are responsible for reviewing your order details before confirming.
• Payment: Full payment is required before any order is sent to production. We accept payment through the methods listed on our Site.
• Pricing: All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. Your final order price will include the cost of the products, plus applicable taxes and shipping fees.

6. Shipping and Delivery

• Turnaround Times: Production and shipping times displayed on the Site are estimates and are not guaranteed.
• Shipping: We ship orders via trusted third-party carriers. Once an order is shipped, the risk of loss and title for the items pass to you.

7. Returns, Refunds, and Cancellation Policy

• No Returns on Custom Products: We cannot accept returns or offer refunds for products that are custom-made to your specifications unless there is a manufacturing error or product defect.
• Manufacturing Errors or Defects: If you receive a product with a clear manufacturing error (e.g., wrong item, incorrect print, significant defect in the garment), please contact us at contact@teedistrict.com. You must provide your order number and clear video evidence of the issue. If we verify the defect, we will, at our discretion, either reprint the affected items or provide a refund.
• Customer Responsibility: Please note that customers are responsible for selecting the correct product sizes. Furthermore, customers are responsible for placing a new order for shipments that are lost or stolen after the risk of loss has transferred to the customer (i.e., upon shipment).
• Cancellations: An order can only be canceled if it has not yet entered the production phase.

8. TeeDistrict Intellectual Property

All content on this Site, including our logo, brand name, website design, text, and graphics, is the property of TeeDistrict and is protected by intellectual property laws.

9. Limitation of Liability

To the fullest extent permitted by law, TeeDistrict shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our Site or services.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada.

11. Changes to Terms of Service

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website.
